Melobil Fleet Rental Terms
These Fleet Rental Terms (“Terms”) govern the rental and use of Melobil electric bicycles (“E-Bikes”) through www.melobil.com and the Melobil mobile applications (“Melobil Services”).
By selecting “I Agree” and proceeding with a rental, the Rider confirms that they have read, understood, and accepted these Terms. These Terms become binding upon electronic acceptance and apply to every E-Bike rented by the Rider through the Melobil Services, unless otherwise stated.
1. Ownership of the E-Bike
All E-Bikes, batteries, chargers, accessories, equipment, and other components provided through the Melobil Services remain the property of Melobil or their respective owner at all times.
Rental does not transfer ownership of any E-Bike or equipment to the Rider.
The Rider receives only a limited right to use the E-Bike during the applicable rental period and in accordance with these Terms.
2. Purpose-Built Delivery Vehicles
Melobil E-Bikes are purpose-built for professional urban delivery operations.
They are engineered around the requirements of intensive daily use, including long working hours, frequent starts and stops, urban environments, varying weather conditions, rider comfort, durability, efficiency, and practical serviceability.
The Rider agrees to use the E-Bike only for its intended purpose and in accordance with applicable laws, safety requirements, and Melobil instructions.
3. Authorized Rider and Use
An E-Bike rented through the Melobil Services may only be used by the Rider to whom the rental is assigned.
The Rider must not lend, transfer, sub-rent, sell, pledge, or otherwise allow another person to use the E-Bike without prior authorization from Melobil.
The Rider must use the E-Bike responsibly, safely, and in compliance with all applicable traffic and other legal requirements.
The Rider must not use the E-Bike for any unlawful, dangerous, or unauthorized purpose.
4. No Unauthorized Repairs or Modifications
The Rider must not repair, modify, dismantle, adjust, replace, or otherwise interfere with any part of the E-Bike without prior authorization from Melobil.
This restriction applies to all components and systems, including but not limited to:
- tires and inner tubes;
- wheels;
- brakes;
- drivetrain;
- motor;
- battery;
- electrical systems and wiring;
- frame and fork;
- display and controls;
- lights;
- accessories;
- locks and security equipment.
This includes flat tires.
If a tire becomes flat or any mechanical, electrical, or other technical problem occurs, the Rider must schedule a repair or E-Bike swap through their Rider Account on www.melobil.com or through the Melobil mobile application.
The Rider must not take the E-Bike to an independent bicycle shop, mechanic, repair service, or other third party without prior authorization from Melobil.
Melobil maintains its own engineering, safety, component, maintenance, and repair standards. Unauthorized repairs or modifications may compromise the safety, reliability, performance, warranty, or proper operation of the E-Bike.
5. Reporting Problems and Damage
The Rider must promptly report any mechanical, electrical, or physical problem affecting the E-Bike through the designated service or support functionality in their Rider Account.
This includes, but is not limited to:
- flat or damaged tires;
- brake problems;
- unusual sounds or vibrations;
- battery or charging problems;
- electrical faults;
- damaged components;
- accidents or collisions;
- missing equipment;
- attempted theft;
- loss of the E-Bike; or
- any condition that may affect safe operation.
The Rider must stop using the E-Bike when continued use could reasonably create a safety risk or cause further damage.
Failure to report a problem promptly may make the Rider responsible for additional damage resulting from continued use, to the extent permitted by applicable law.
6. Maintenance, Repair, and E-Bike Swap
Melobil is responsible for authorized maintenance and repairs according to its own service standards.
When a technical or mechanical issue occurs, the Rider must use their Rider Account to schedule the appropriate service.
Following the Rider's request, Melobil may determine whether the appropriate solution is:
- repair of the E-Bike;
- replacement of a component;
- inspection;
- or an E-Bike swap.
The Rider must follow the instructions provided through their Rider Account and make the E-Bike available as required.
Where available, Melobil may provide a replacement E-Bike to minimize operational downtime.
The Rider must not arrange repairs independently or through a third party without Melobil's authorization.
7. Rental and Repair Payments
Rental fees are automatically charged to the payment card provided by the Rider through the Melobil Services in accordance with the applicable rental arrangement.
Following inspection of an E-Bike submitted or returned for repair, Melobil may determine that a repair, replacement, or other service is required due to damage, misuse, unauthorized intervention, accident, or another cause that does not constitute normal use and ordinary wear and tear.
Where the Rider is responsible for such costs under these Terms, the applicable repair or damage charge may be automatically charged to the payment card provided by the Rider, subject to applicable law and the applicable rental terms.
The Rider authorizes Melobil to process such charges in accordance with these Terms.
8. Rental Billing Cycle and Refunds
Rental fees are charged according to the applicable rental billing cycle displayed through the Rider Account.
Once a billing cycle has commenced, payments made for that active billing cycle are non-refundable, including where the Rider stops using or returns the E-Bike before the end of the active billing cycle, subject to any mandatory refund rights under applicable law.
Returning the E-Bike or stopping its use does not automatically terminate the active billing cycle or create a right to a refund for the unused portion of that cycle.
Any cancellation, termination, or return of the E-Bike will be handled according to the applicable rental procedure and billing terms displayed through the Rider Account.
9. Payment Status and Motor Restriction
The Rider's rental and repair payment status is displayed in the Finance section of the Rider Account.
Where a rental payment or applicable repair or damage charge cannot be successfully collected, the relevant payment may be displayed as “Exhausted.”
For the purposes of these Terms, “Exhausted” means that an attempted payment has not been successfully collected and the applicable amount remains outstanding.
If an applicable rental or repair payment is displayed as “Exhausted,” Melobil's system may automatically disable the E-Bike's motor, preventing further motor-assisted use until the applicable payment issue is resolved, subject to applicable law.
The Rider may review the payment status and follow the available payment procedure through their Rider Account.
10. Theft, Loss, and Protection of the E-Bike
The Rider is responsible for taking reasonable care of the E-Bike and protecting it against theft, loss, unauthorized use, and avoidable damage.
The Rider must:
- properly use all security equipment provided by Melobil;
- secure the E-Bike whenever it is unattended;
- take reasonable precautions against theft;
- keep keys, access credentials, and security equipment secure; and
- follow any security instructions provided by Melobil.
In the event of theft, disappearance, or attempted theft, the Rider must immediately notify Melobil and, where required, report the incident to the appropriate authorities.
The Rider must provide Melobil with all information reasonably required concerning the incident, including any relevant police report or reference number.
Theft and Loss Compensation
If an E-Bike, battery, charger, accessory, or other Melobil property is stolen, lost, or cannot be recovered as a result of the Rider's intentional act, negligence, misuse, breach of these Terms, unauthorized use, failure to properly secure the equipment, or other circumstances attributable to the Rider, the Rider shall be responsible for the resulting loss to the extent permitted by applicable law.
Such responsibility may include the replacement value or reasonable recovery costs of the affected property, together with other directly resulting costs where legally recoverable.
11. E-Bike Condition and Return
11.1 Damage and Missing Components
The Rider must return the E-Bike and all supplied equipment in the condition in which they were provided, subject to normal use and ordinary wear and tear.
The Rider may be responsible for damage or loss resulting from:
- misuse or negligent use;
- unauthorized repairs or modifications;
- accidents attributable to the Rider;
- improper storage;
- misuse of the battery or charger;
- failure to report a problem;
- removal or loss of components;
- unauthorized use; or
- other acts or omissions attributable to the Rider.
Normal use and ordinary wear and tear resulting from proper use does not constitute Rider-caused damage.
11.2 Cleanliness and Return Condition
The Rider must return the E-Bike in a reasonably clean condition consistent with the condition in which it was provided.
The Rider is responsible for keeping the E-Bike reasonably clean during the rental period and must not return the E-Bike with excessive mud, dirt, food residue, grease, waste, or other contamination resulting from the Rider's use.
If an E-Bike is returned in a condition requiring cleaning beyond ordinary routine cleaning, Melobil may arrange for the E-Bike to be professionally cleaned or washed according to its service standards.
The applicable cleaning or bike-washing cost may be invoiced to the Rider and charged to the payment card provided by the Rider, subject to applicable law and the applicable rental terms.
12. Accidents and Collisions
Any accident, collision, or event causing damage to the E-Bike must be reported to Melobil as soon as reasonably possible through the available support functionality.
The Rider must not attempt to repair, conceal, modify, dispose of, or otherwise interfere with accident-related damage or components without Melobil's authorization.
Where required by law or circumstances, the Rider must also contact the appropriate emergency or law-enforcement authorities.
13. Battery and Electrical Systems
13.1 Battery and Electrical Safety
The Rider must use the battery, charger, motor, electrical systems, and related equipment only as instructed by Melobil.
The Rider must not:
- open or dismantle the battery;
- modify electrical connections;
- attempt electrical repairs;
- bypass safety systems;
- use unauthorized charging equipment;
- intentionally damage the battery; or
- otherwise interfere with the electrical system.
Any unusual heat, smell, smoke, swelling, leakage, or other abnormal battery behavior must be reported immediately.
The Rider must discontinue use where continued operation could create a safety risk.
13.2 Prohibited Electrical Equipment
The Rider must use only the battery, charger, and electrical components supplied with or installed by Melobil for the E-Bike.
The Rider must not connect, install, substitute, or use any other:
- battery;
- charger;
- charging cable, adapter, or converter;
- electrical accessory;
- lighting or powered accessory; or
- other device connected directly or indirectly to the E-Bike's electrical system.
Use of any non-Melobil electrical equipment is strictly prohibited. Such equipment may compromise the compatibility, safety, integrity, and technical compliance of the E-Bike's electrical system and may cause electrical failure, overheating, fire, battery damage, or damage to the E-Bike.
14. Speed Limitation and Off-Road Mode
Melobil E-Bikes are configured with a maximum assisted speed of 25 km/h for urban use, in accordance with applicable operating and legal requirements.
The Melobil mobile application may provide an Off-Road Mode that allows the applicable speed limitation to be increased or removed for use in areas where such operation is legally permitted.
The Rider must not activate or use Off-Road Mode through the Melobil mobile application while operating the E-Bike in an urban area, on public roads, or in any other location where the applicable speed limitation is legally required.
The Rider is solely responsible for ensuring that the E-Bike is operated within all speed limits and other requirements applicable to the location where it is being used.
The Rider must not use Off-Road Mode to circumvent legally applicable speed limitations.
If the Rider activates or uses Off-Road Mode in an area where unrestricted operation is not legally permitted, the Rider is solely responsible for any resulting fine, penalty, traffic violation, seizure, confiscation, impoundment, administrative action, or other consequence imposed by a competent authority, to the extent permitted by applicable law.
Any costs incurred by Melobil as a result of the Rider's unauthorized use of Off-Road Mode, including costs associated with recovery, transport, inspection, or release of the E-Bike where legally recoverable, may also be charged to the Rider.
The Rider must immediately notify Melobil if the E-Bike is stopped, seized, impounded, or otherwise subject to action by an authority.
The availability of Off-Road Mode within the Melobil mobile application does not constitute permission to use the E-Bike at unrestricted speeds in areas where such use is prohibited by law.
15. Geofencing and Urban Operating Area
Melobil E-Bikes may operate with a GPS-based geofencing system that defines the permitted operating area of the E-Bike.
If the Rider travels outside the designated urban operating zone, the E-Bike's motor may be automatically disabled by the Melobil system.
The Rider acknowledges that geofencing is an integral part of Melobil's fleet-management and operational system.
The Rider must not disable, manipulate, bypass, interfere with, or attempt to circumvent the geofencing system.
The Rider is responsible for remaining within the permitted operating area while using the E-Bike.
16. Connected Systems and Security
Melobil E-Bikes may contain GPS, telemetry, diagnostic, connectivity, identification, anti-theft, geofencing, or other electronic systems used for fleet management, security, maintenance, safety, and operational purposes.
The Rider must not remove, disable, manipulate, obstruct, damage, or attempt to circumvent any such system.
The Rider must not attempt to access, alter, reverse engineer, or interfere with any software, firmware, connectivity system, or electronic control system installed on the E-Bike.
Interference with these systems may constitute a material breach of these Terms.
17. Inspection and Vehicle Exchange
Melobil may inspect an E-Bike when reasonably necessary for maintenance, safety, quality control, fleet management, or verification of its condition.
Inspections may include checking the physical condition of the E-Bike, its components, battery, security equipment, connected systems, and signs of unauthorized modification or damage.
Melobil may require an E-Bike to be returned, inspected, repaired, or exchanged.
Where appropriate and available, Melobil may provide a replacement E-Bike to minimize operational downtime.
18. Return of the E-Bike
The Rider must return the E-Bike and all supplied equipment when the rental ends, when the rental is terminated, or when Melobil lawfully requires its return.
The E-Bike must be returned in accordance with the applicable Melobil return procedure.
Failure to return an E-Bike or other rented equipment may result in additional charges, suspension of the Rider's account, recovery action, and other remedies available to Melobil under applicable law.
19. Suspension and Termination
Melobil may suspend or terminate a Rider's rental privileges in accordance with these Terms and applicable law, including in cases of:
- unauthorized use;
- unauthorized repair or modification;
- theft or suspected misuse;
- repeated or serious damage;
- failure to return an E-Bike;
- interference with security, geofencing, or connected systems;
- material breach of these Terms;
- conduct creating a significant safety or operational risk; or
- other circumstances permitted by the applicable rental terms or law.
Upon termination, the Rider must return the E-Bike and all associated equipment as instructed by Melobil.
20. Rider Responsibility
The Rider acknowledges that an E-Bike is a vehicle requiring responsible and safe operation.
The Rider is responsible for:
- operating the E-Bike safely;
- complying with applicable traffic regulations;
- using appropriate safety equipment where required;
- following Melobil's operating instructions;
- protecting the E-Bike from avoidable damage, theft, and misuse; and
- promptly reporting problems and incidents.
The Rider must not operate the E-Bike while impaired or in circumstances where the Rider is unable to operate it safely.
21. Electronic Acceptance
These Terms are accepted electronically through www.melobil.com or the Melobil mobile applications.
By selecting “I Agree” before renting an E-Bike, the Rider confirms that they:
- have had the opportunity to read these Terms;
- understand their responsibilities;
- agree to comply with these Terms;
- acknowledge the rules concerning theft, damage, maintenance, repair, payments, geofencing, and motor restrictions; and
- accept these Terms as governing their use of Melobil E-Bikes.
The electronic acceptance may be recorded together with the applicable Terms version and associated account and transaction records as evidence of acceptance, subject to applicable law.
22. Changes to These Terms
Melobil may update these Terms from time to time to reflect changes in its services, fleet, technology, operational procedures, or applicable legal requirements.
The applicable version of the Terms will be presented through www.melobil.com or the Melobil mobile applications as required.
Rider Acknowledgment
By selecting “I Agree,” the Rider confirms that they have read, understood, and accepted the Melobil Fleet Rental Terms.
The Rider specifically acknowledges that:
• The E-Bike remains the property of Melobil or its respective owner.
• The Rider has no right to repair, modify, dismantle, or otherwise interfere with the E-Bike or any of its components without Melobil's authorization, including repairing flat tires.
• All mechanical and technical issues must be reported through the Rider Account, where the Rider must schedule a repair or E-Bike swap.
• Repair or damage costs resulting from causes other than normal use and ordinary wear and tear may be automatically charged to the Rider's provided payment card, where permitted by applicable law.
• The Rider is responsible for protecting the E-Bike against theft, loss, misuse, and avoidable damage.
• The Rider may be responsible for theft, loss, or damage attributable to the Rider's actions or omissions, to the extent permitted by applicable law.
• The E-Bike may use geofencing, and its motor may be automatically disabled when the E-Bike leaves the permitted urban operating area.
• Where a rental or applicable repair payment is shown as “Exhausted” in the Finance section of the Rider Account, the E-Bike's motor may be automatically disabled until the outstanding payment issue is resolved, subject to applicable law.
• Melobil may use connected systems for fleet management, security, maintenance, safety, geofencing, and operational purposes.
